Or just show them a copy of IDEA law that does NOT state that a school can do this. Show them that The school has only 2 choices in this matter. Either grant the eval and do it within the legal timeline, or give the parent prior written notice as to why they will not do the eval.
That will stop the whole mess in its tracks.
